Introduction

The Foundation for the Remembrance of Slavery exchanges with its employees, project leaders, experts and donors, and communicates about its activities, particularly via its newsletter and annual report. The purpose of this data confidentiality policy is to inform you of the practices and conditions under which it collects and processes personal data.

This policy applies to all data collected on the websites of the Foundation for the Remembrance of Slavery and in the context of its relations, of whatever nature. As a data processor, the Foundation for the Remembrance of Slavery undertakes to comply with the provisions laid out in amended Act No. 78-17 of 6 January 1978 and the General Regulations on Data Protection published in the Official Journal on 27 April 2016, which came into effect on 25 May 2018.

It undertakes to inform you of the way we process your personal data, to give you control over its use and to protect it. You will find information below about the type of data we collect about you, how and why we collect it, how we use it and how we protect it. This privacy policy also tells you your rights, how you can exercise them and how the law protects you.

What data do we collect about you?

We collect the information necessary to carry out our activities and to keep you informed. We only share your information with our technical service providers and, exceptionally, with some of our partners (see below).

We may collect, use, store and transfer different types of personal data about you. We have grouped them together as follows:

  • Identity data: full name, title and gender.
  • Contact data: home address, business address, e-mail address and telephone numbers.
  • Technical data: IP address, connection data, traffic data, browser type and version, time zone settings and location, browser plug-in types and versions, operating system and platform, and other information about how you access our website.
  • Usage data: information about how you use our website.

We do not have any information about your background, religious or philosophical beliefs, sexual orientation, political opinions, union affiliations or health.

How is your personal data collected?

Generally speaking, we collect personal information about you when you decide to interact with us (email, sending an application for financial support, subscribing to the newsletter) or when you express an interest in our activity. We also look at how you use our website so that we can provide you with the best possible experience.

  • To ensure the smooth running of the process of appraisal, expertise and monitoring of projects submitted to the Foundation.
  • To carry out banking transactions related to the partnership agreements signed by the Foundation.
  • To keep you informed about the Foundation's activities.
  • For statistical analysis.
  • To operate and improve our website.
  • To inform you of any changes to our website or procedures that may affect you.
  • To provide you with technical support.
  • To enforce our legal rights or comply with legal requirements.

We use your personal data only when we are legally permitted to do so, namely:

  • When we have to accomplish the terms of the partnership agreement signed with you.
  • When we have to comply with a legal or regulatory obligation.
  • When we have legitimate interests related to the Foundation's activities. We carefully consider  any potential negative impact on you and your rights before processing your personal data.

How do we share your personal data, and with whom?

We share your personal data with third party companies as detailed below. We may also transfer your personal data outside the European Economic Area (EEA), but only where specific safeguards have been put in place to protect your personal data.

We may share your personal data with one or more external third parties:

  • Service providers we hire to perform services on our behalf, such as bulk emailing or mailing. These companies are based in France and the United States.
  • Regulators and other authorities that require reporting of activities in certain circumstances.
  • On an exceptional and ad hoc basis, the Foundation may be required to share personal data with its partners for one-time use for specific information purposes (e.g., invitation to events, etc.).

We ask all third parties to respect the security of your personal data and to process it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes. We only allow them to process your personal data for specific purposes and in accordance with contractual obligations, which ensure adequate protection of your data.

How we protect your personal data?

We are committed to protecting your personal data. We implement safeguards, including appropriate technology, policies and contractual arrangements, to ensure that the data we have about you is protected against unauthorised access and improper use. Finally, we will not retain your personal data longer than necessary.

How long do we use your personal data??

We will only retain your personal data for as long as is necessary for the purposes set out in this privacy statement and to fulfil our legal obligations. We will not retain more data than we need.

If you no longer wish to receive information from the Foundation, we will delete your personal data as soon as we receive your request to unsubscribe.

We are required to keep certain essential information about our partners for a longer period of time in order to comply with applicable laws. Under certain circumstances, you may file a request to have your data deleted (see below).

The Foundation promises to do everything it can to ensure your right to be forgotten, in accordance with the current state of the art and our practices.

What are your rights?

Under certain circumstances, you have rights under data-protection laws relating to your personal data, including the rights to access, correct, erase and restrict processing your data, as well as the right to data portability and the right to object.

Under European data-protection laws, you have a number of rights in relation to your personal data. These rights are not absolute - in some cases they will not apply to you, or to the particular use we make of your data. There are exceptions, for example if we need to process the data to comply with our own legal obligations, but if this is the case we will let you know.

Your rights include:

Access to your personal information
The ability to request any changes or corrections to your information
The right to require the deletion of personal information about you (unless otherwise regulated)
To receive the personal information you have provided us with in a structured, commonly used, machine-readable format, and to have the right to pass this data on to a third party in certain situations.
That of opposing at any time the processing of your personal information for sending you our newsletter and other communications. In this case, the Foundation will not be able to keep you informed of its activities.
